Official Rules of the 2016 Luann Wedding Dress Design Contest

Please read these Official Rules before entering yourself (the “Entrant“) into the 2016 Luann Wedding Dress Design Contest (the “Contest“). It is understood and agreed by the Entrant that the Contest is a “contest,” and is in no way considered to be a sweepstakes or giveaway. By submitting an Entry (as defined herein), you represent that you and your Entry meet all of the below-stated requirements and you agree to be bound by these Official Rules and by the decisions of Andrews McMeel Universal (“AMU“).

NO PURCHASE IS NECESSARY TO ENTER OR WIN AND WILL NOT INCREASE THE CHANCE OF WINNING.

  1. ELIGIBILITY: In order to enter the Contest, you must be: (a) eighteen (18) years of age or older; (b) a legal resident of the United States and; (c) not an owner, employee, officer or director of AMU, any of its affiliates, any of its advertising agencies or any other entities involved in the development, production, administration, sponsorship or fulfillment of the Contest, or an immediate family member of any such person. AMU and all of the entities and individuals identified herein are collectively referred to in these Official Rules as “AMU and its Affiliates.”
     
  2. CONTEST SUBMISSION PERIOD: To enter, during the Contest Submission Period described below, the Entrant must submit a Valid Entry to AMU as described in paragraphs 1 and 3 of these Official Rules (a “Valid Entry“). The “Contest Submission Period” begins at 12:01 a.m. U.S. Central Daylight Time on September 16, 2016, and ends at 11:59 p.m. U.S. Central Daylight Time on October 3, 2016. One (1) Valid Entry will be selected as the winner (the “Winner“). Valid Entries must be received by the end of the Contest Submission Period. AMU’s servers and clock will be deemed the official clock and Entrant’s proof of submission does not constitute proof of AMU’s receipt. AMU and its Affiliates are not liable for any lost, late, misdirected, incomplete, illegible, undelivered, garbled or delayed entries regardless of cause or person responsible including, but not limited to, any problem or technical malfunction of any computer, online system or server or technical problem or traffic congestion on the Internet or at any submission website.
     
  3. ENTRY REQUIREMENTS: Up to ten (10) Valid Entries per Entrant will be accepted during the Contest Submission Period. To enter, the Entrant must meet the eligibility requirements in paragraph 1 above and the Entrant must timely submit the following to AMU (in the manner specified below) during the Contest Submission Period: (a) one or more original designs of a wedding dress for the comic character “Toni” in the Luann comic strip by Greg Evans (the “Comic Strip”) in electronically up-loadable form (the “Dress Design“); and (b) a completed application in the form designated by AMU and found at www.luannfan.com (the “Application“). The Dress Design and completed Application submitted by the Entrant are collectively referred to in these Official Rules as an “Entry“. In addition, the Dress Design must (A) not violate or infringe any copyright, privacy or publicity right, or other proprietary or intellectual property right of any person or entity; and (B) not be defamatory, libelous, profane, vulgar, obscene or otherwise illegal, objectionable or inappropriate as determined by AMU in its sole discretion. The Entry may be submitted to AMU by uploading the Entry on www.luannfan.com. By submitting an Entry, the Entrant represents and warrants that the Entry meets all of the above Entry requirements and that the Entrant has obtained any and all necessary third party consents required in connection with the submission of the Entry and its use by AMU and its Affiliates as permitted hereunder, including, without limitation, the consent of each person involved in creating the Dress Design. AMU reserves the right, in its sole and unfettered discretion, to require proof of such consent and to disqualify at any time any Entry it deems not in compliance with these Official Rules. All timely received Entries determined by AMU in its sole discretion to comply with the requirements of paragraphs 1, 2 and 3 above will be deemed Valid Entries. Entries will not be returned. AMU reserves the right to, at its sole discretion, cancel, suspend and/or modify the Contest or these Official Rules or disqualify any individual or Entry for purposes of protecting the integrity of the Contest or addressing changes in business operations or other circumstances, to the extent allowed under applicable law.
     
  4. GRANT OF RIGHTS. By submitting an Entry, the Entrant grants to the AMU and its Affiliates an irrevocable, exclusive worldwide license to use all or any part of the contents of such Entry, including any derivative works, without any compensation to the Entrant or any attribution by name to the Entrant for any Contest purpose(s) at any time and in any and all media now or hereafter devised. Such grant of rights includes, without limitation, the right of AMU and its Affiliates to use the name, likeness and biographical information of the Entrant in any media and for any contest purpose without payment or consideration and the rights of AMU and its Affiliates to edit the formatting, content and display of the Entry and create derivative works for contest purposes without seeking the approval of the Entrant or making any payment to the Entrant. In addition, to the extent moral rights (for example, the right to attribution and the right to integrity) apply in the applicable jurisdiction, each Entrant waives (and to the extent that these may not be waived, irrevocably agrees not to assert) any moral rights in the Entry for any purposes, including, without limitation, AMU and its Affiliates’ use of all or part of the Entry for contest purposes. AMU’s decision to post or publish all or part of an Entry on any of AMU’s web site(s) or any other web site (including, without limitation, any social networking site) does not mean that the selected Entry has been selected as a Finalist or as the Winner.
     
  5. CONTEST JUDGING AND AWARD PROCESS. Once all Valid Entries have been received and tentatively determined, AMU will publish the Dress Design(s) associated with the Valid Entries online at www.luannfan.com and visitors to such site will be allowed to vote for their favorite Finalist using the voting mechanism on the site (the “Online Vote“). The Online Vote shall begin at 12:01 a.m. U.S. Central Daylight Time on October 6, 2016, and run through 11:59 p.m. U.S. Central Daylight Time on October 17, 2016 (the “Online Voting Period“). Visitors may submit one (1) vote per person per 24 hour period. AMU reserves the right, in its sole discretion, to exclude votes from any person who AMU determines voted more than one (1) time per 24-hour period during the Voting Period and any votes AMU concludes were generated by script, macro or other automated means or would subvert the voting process. Finalists are prohibited from directly or indirectly obtaining votes by any fraudulent or inappropriate means including, without limitation, offering prizes or other inducements to members of the public, as determined by AMU in its sole discretion. Once the Online Voting Period ends, the Dress Design with the highest number of votes will be tentatively selected the Winner and will be notified by email. If a tentatively selected winner fails to respond within 2 (two) days or if AMU determines a tentatively selected winner ineligible for any reason, then AMU, in its sole discretion, may deem his or her selection forfeited and select the second-place vote as Winner.
     
  6. PRIZES; ODDS. The Winner’s Dress Design will be recreated in the Comic Strip during an upcoming “wedding” storyline (the “Prize“). The value of the Prize cannot be determined because it is not transferrable and there is no established market for the Prize. Odds of winning cannot be determined because they are based on the total number of Valid Entries received during the Contest Submission Period.
     
  7. RELEASE OF LIABILITY, LIMITATION OF LIABILITY, AND INDEMNITY: By entering, the Entrant, on behalf of Entrant and Entrant’s spouse (if applicable), assigns, guardians, administrators, executors and legal representative: (a) agrees to be bound by these Official Rules and the decisions of AMU; (b) releases, waives, discharges, covenants not to sue, and indemnifies AMU and its Affiliates from and against any and all losses, damages, claims and actions of any kind arising from participation in the Contest, from AMU’s use of all or any part of an Entry (including, without limitation, claims based on publicity rights, moral rights, defamation or invasion of privacy), from the Entrant’s acceptance or use of the Prize; (c) agrees that AMU and its Affiliates may send Entrant marketing, advertising and promotional materials to the email address(es) provided in the Entry; and (d) agrees that any action at law or in equity arising out of or relating to this Contest shall be governed by the law and provisions specified in paragraph 8 below and that Entrant hereby consents to the personal jurisdiction of the courts specified in paragraph 8 for purposes of any such action; . Without limiting the generality of such release, each Entrant agrees that AMU and its Affiliates are not responsible for any third party’s unauthorized use of any Entry (or any portion thereof or any derivative thereto). Further, without limiting the foregoing, each Entrant hereby specifically waives any and all rights to claim punitive, incidental or consequential damages. Each Entrant agrees to indemnify, defend and hold harmless AMU and its Affiliates from claims arising from any claim that the Entry content infringes or otherwise violates the rights of a third party.
     
  8. GOVERNING LAW: The Contest shall be governed by the laws of the State of Missouri without giving effect to any choice of law or conflict of law rule of any jurisdiction. Any claims regarding the Contest must be brought in the State or Federal Courts in Jackson County, Missouri, and the Entrant hereby consents to the personal jurisdiction of such courts for purposes of any such action. Each Entrant waives his or her right to a jury trial. The Contest is void outside the United States and where prohibited by law.
     
  9. CONTEST SPONSOR AND IDENTITY OF THE WINNER. The sponsor of the Contest is Andrews McMeel Universal, and the address of its headquarters is 1130 Walnut, Kansas City, Missouri 64106. You may obtain the name of the Winner by sending a request (identifying the “2016 Luann Wedding Dress Design Contest”) to the above address, together with a stamped, self-addressed #10 envelope. The name of the Winner will also be posted on the Contest webpage.
